A “Trick Being Used by the Radical Left Communists, Marxists, and Fascists”: Trump’s 2024 Eligibility Challenge Gets the Boot

At the start of October, the US Supreme Court dismissed a case questioning the eligibility of former President Donald Trump for the 2024 election based on a constitutional provision that disqualifies anyone who has ‘engaged in insurrection or rebellion’ from holding public office.

Supreme Court Rejected an Appeal by John Castro

The justices dismissed the appeal by Texas tax consultant John Anthony Castro, who embarked on an improbable bid for the Republican Presidential nomination. He sought to challenge Trump’s eligibility under the 14th Amendment of the US Constitution, but the lower court had previously ruled that he lacked the legal standing to pursue such a lawsuit.  

Castro Cited Trump’s Actions on January 6 as Insurrection

Castro cited Trump’s involvement in the events surrounding the January 6 attack on the US Capitol by his supporters as evidence of insurrection.  

Section Three, a “Fringe Legal Theory” Say Trump Supporters

Castro’s argument hinges on Section Three of the 14th Amendment, a provision dating back to the Civil War era, which was historically used to disqualify former members of the Confederacy from holding public office. Critics of this interpretation of Section Three have characterized it as a “fringe legal theory.”  

Castro Lost Cases in Lower Courts

The Supreme Court Justices refrained from pursuing one of Castro’s cases subsequent to his previous loss in a lower court. Castro had filed similar lawsuits in various states, including South Carolina, Arizona, and Colorado. According to court records, Castro’s cases have been dismissed in Maine, Pennsylvania, Utah, and Oklahoma.  

Trump’s Lawyers Lashed Out at Castro

“The reason he will get no votes and no contributions — no matter who is running— is that no one has ever heard of him,” Trump’s attorneys wrote. “Certainly, he has offered no evidence, as opposed to speculation untethered to reality, to support his claim to the contrary,” they said in response to one of Castro’s lawsuits.

“The fight is far from being over,” Castro said on X. “We’re going to get the liberal 9th Circuit to kick Trump off the ballot in Montana, Idaho, Nevada, and Arizona. Coupled with the 1st Circuit kicking him off the Maine ballot, there’s ZERO path to 270.”  

Castro Is Still Pursuing Decisions in Liberal Appellate Courts

“The Supreme Court can deny to hear the case, but appellate courts cannot,” Castro wrote on X (Twitter.) “I’m still pursuing decisions in the liberal appellate courts, and there’s a full-blown trial scheduled for October 20 in New Hampshire and a bench trial in Arizona on October 31,” he added.  

Similar Lawsuits Launched in Colorado, Minnesota and Michigan

Besides Castro’s legal pursuits, numerous other cases have been initiated against Trump under the 14th Amendment, Section Three.

In this recent development, Colorado District Judge Sarah Wallace rejected Trump’s lawyers’ request to have the lawsuit dismissed on the grounds of free speech. However, it’s worth noting that Trump is still pursuing several pending challenges in relation to this case, which the liberal government watchdog group initiated.

Despite facing four criminal indictments, including three in federal court and one in Georgia related to his alleged efforts to overturn the 2020 election results in the state, Trump continues to lead in Republican primary polls.

Furthermore, in Trump’s defense, at least one state’s highest-ranking election official has already rebuked the legal theory surrounding Section Three and said anyone meeting the eligibility criteria to run for office will have their name included on the ballot.  

Trump’s Name Will Appear on the Presidential Primary Ballot

“As long as he submits his declaration of candidacy and signs it under the penalties of perjury and pays the $1,000 filing fee, his name will appear on the presidential primary ballot,” New Hampshire Secretary of State David Scanlan said in an interview with the Press.  

“We’ll Have to See How That Plays Out.”
