“Disbarred and Out of Public Attention” – Giuliani’s Election Fight Sparks Outrage as Legal Battles Rage On

In the wake of the 2020 election, Rudy Giuliani has become a central figure in a heated debate. This is over the integrity of legal challenges to election outcomes. Disciplinary lawyers are pushing for Giuliani, once a revered New York City mayor, to be disbarred for his efforts in trying to overturn the election results. His attorneys, however, argue that he was representing his client.

No Evidence Found in Pennsylvania Lawsuit

The federal lawsuit in Pennsylvania came under severe scrutiny when Giuliani presented multiple allegations of election fraud. During the proceedings, Phil Fox, representing the disciplinary counsel, asserted, “None of these claims were supported by evidence.” His statement raised serious doubts about the lawsuit’s credibility.

Severe Consequences for Misconduct

Fox clarified the potential consequences of Giuliani’s conduct. He asked, “was [Giuliani’s] actions so harmful?” He expressed a strong conviction that Giuliani’s actions during the election challenges could require disbarment. This clearly shows the seriousness with which the disciplinary counsel views the case.

Defense of Challenging Election Results

Amid the controversy, Giuliani’s defense attorneys, Leventhal and Kamins, stood by the principle that courts are the proper venue for contesting grievances. They argue that even cases that do not succeed still contribute to the integrity of the judicial process. This suggests a broader perspective on the function and value of legal challenges.

Sanctions for Trump’s Campaign Lawyers

The spectrum of sanctions given Trump’s campaign attorneys has been broad, ranging from financial consequences to censure and, for some, disbarment. Giuliani finds himself at a crossroads within this broader context. His professional future is hanging in the balance as he faces potential disciplinary action for his role in the post-election litigation.

Professional Responsibility Board in Action

The Board on Professional Responsibility of the D.C. Court of Appeals has taken up the mantle to deliberate Giuliani’s professional fate. Bernadette, Sargeant, chair of the board, probed the nature of Giuliani’s actions. She questioned whether his public support crossed a line into professional misconduct.

Arguments Lacking Factual Basis

Without directly accusing Giuliani of lying, the disciplinary board signaled that his legal arguments lacked a factual foundation. Sargeant showed concerns about the consequences of punishing Giuliani and how they might extend beyond his individual case. She fears that this could discourage attorneys from representing unpopular or difficult cases.

Seeking a Punishment Fit for the Misconduct

The dialogue around appropriate sanctions continued as board member Robert Walker contemplated other sanctions. These fell short of disbarment. Contrasting this view, Fox stood firm in his position. He insisted on disbarment as the only suitable punishment in light of the serious nature of Giuliani’s alleged infractions.

Temporary Suspension Already in Place

In July 2023, Giuliani’s law license was suspended. This served as an initial response to the charges of professional misconduct. Critics argue that this could be a prelude to stricter disciplinary actions. These potential consequences will all be based on the outcomes of the ongoing proceedings.

The Pennsylvania Federal Lawsuit

The central issue of the Pennsylvania lawsuit involved an attempt to invalidate a swath of mail-in ballots. This pivotal lawsuit became a central point in the argument for taking disciplinary action against Giuliani. This was particularly important, given the consequences for the integrity of the electoral process.

Accusations of Election Theft

In a dramatic moment during the lawsuit’s oral arguments, Giuliani charged that the Democrats had orchestrated an election theft. This accusation was met with skepticism by disciplinary lawyers. They insisted such allegations were not supported by evidence and had no bearing on the election’s outcome.

Historical Precedent for Lawyer Misconduct

Disciplinary lawyers stated that not even during the Civil War did attorneys seek to overturn an election result. This historical context was used to highlight the nature of Giuliani’s attempt to challenge the 2020 election results. They argued that there was no historical nor evidential proof of his claims.

No Legal Precedent for Claims

The U.S. District Court and the 3rd U.S. Circuit Court of Appeals dismissed the legal basis of Giuliani’s lawsuit. This fact supports the disciplinary counsel’s argument for action against him. The absence of legal precedent for his claims has strengthened the calls for disciplinary measures.

Violation of Professional Rules

The allegations against Giuliani center on the possibility that he violated professional conduct rules. They claim he pursued an allegedly frivolous lawsuit. These concerns cast a shadow over his future in the legal profession and raise critical questions about his judgment and adherence to legal ethics.

Calls for a Less Severe Sanction

Despite facing intense scrutiny and criticism, Giuliani and his legal team maintain that his representation was a legitimate effort on behalf of his client. They call for a sanction that stops short of disbarment. They have proposed that a less severe penalty would be sufficient for the circumstances at hand.

Rudy’s Past Roles

Giuliani was once praised for his leadership following the September 11 attacks. But now, he finds his legacy in jeopardy. Supporters have pointed out his historic role in New York, stating, “After all of his hard work bringing NY back from 911 by coordinating the healing of a nation is the mark of a hero.” However, others counter this by highlighting recent actions, arguing that “All his past accomplishments do not absolve his poor choices in defending and conspiring with ‘The King Of Fraud’ Trump.”

Verifying Mail-In Ballot

The discourse surrounding mail-in ballot verification remains controversial, with Giuliani’s critics questioning the legitimacy of his claims. One commentator remarked, “Meanwhile, nobody can explain how a single mail-in ballot ‘signature’ is verified.” Clearly, the disputes over the verification process during the election are complex.

Lin Wood vs Giuliani

Some have suggested Giuliani should take a path similar to that of attorney Lin Wood, who chose to surrender his law license after controversy. One user said, “Lin Wood had the good sense to surrender his Law License and retire,… you should follow suit, Rudy!” It seems some believe Giuliani’s ongoing battles may be damaging more than just his reputation but also his legacy.

Some critics have questioned, “Where is Goonie getting the $$ for this case? I thought he was broke.” Another user spoke about the consequences for Giuliani. They said, “Disbarred, and out of public attention. Giuliani has made the worst choices under America’s Traitor President.”
